Immigration Fraud Scheme Used Cuban Adjustment Act

HAVANA TIMES — In yet another shameful spectacle for the defenders of the Cuban Adjustment Act (CAA), 14 people stood before a Miami federal court this Thursday on charges of contracting false marriages and committing immigration fraud to take advantages of the benefits afforded by the legislation.
According to a report from the South Florida Federal District Attorney’s Office, the frauds were committed between December 2009 and July 2014. They were perpetrated by two individuals identified as 51-year-old Odalys Marrero and 62-year-old Rolando Mulet, both residents of Kendall.
The alleged leaders of the fraud network recruited Cuban citizens who were eligible for permanent residency in the United States under the CAA and arranged fraudulent marriages with foreigners willing to pay for the service in order to evade the immigration regulations applicable to them.
Arranged Marriages
Marrero and Mulet are accused of conspiring with six Cuban nationals and six non-Cuban hispanics to arrange these fraudulent marriages. The charges are conspiracy to arrange fraudulent marriages and related immigration fraud.
Marrero and Mulet are accused of charging foreigners for arranging the marriage, notarizing the fraudulent marriage certificates, filling out all of the migratory documents required and preparing the conspirators for their interviews with officers from the US Citizenship and Immigration Service (USCIS).
Under the CAA – in effect since 1966 – any Cuban citizen may obtain permanent US residency (for themselves and their spouses, regardless of their nationality) after residing in the United States for a year and submitting a valid entry document (known as a “parole” document).
Some 30,000 Cubans secure permanent residency in the United States every year under the CAA. The most recent figure (from 2013) was of 32,219 such cases.
The six marriages registered in the document were contracted in South Florida. With the exception of two, the accused reside in the Miami-Dade County.
Severe Sentences and Deportation in Sight
The case is being tried by assistant district attorney Robert Emery.
In addition to Marrero and Mulet, the following individuals were also arrested and charged:
Katiusca Elena Aguilar Navarro, 28 years old, from Doral.
Carlos Alberto Mederos Paule, 46 years old, from Miami.
Manuel Andres Gomez, 46 years old, from Wilton Manors (Broward).
Virginia De La Caridad Mederos Paule, 57 years old, from Miami.
Elisabet Kerese Alvarez, 38 years old, from Aventura.
Osvaldo Lastre Duran, 48 years old, from Sweetwater.
Natacha Perera, 44 years old, from North Miami.
Javier Manejias, 51 years old, from Antioch (Tenessee).
Marianelly Auxiliado Rodriguez, 48 years old, from Doral.
Rafael Abreu Gonzalez, de 46 years old, from Hialeah.
Okyvi Olmar Yoll Mesa, 35 years old, from Doral.
Salvador L Cabanas, 44 years old, from Kendall.
If they are found guilty the accused could face 20-year prison sentences. Because they committed felonies, all of the accused would be processed for deportation after serving their sentences.
United States Attorney Wifredo A. Ferrer stated, “Marriage and immigration fraud is a serious crime that seeks to undermine the integrity and fairness of our immigration system. Our Office will continue to work with our law enforcement partners to investigate these crimes and prosecute those individuals who seek to perpetrate fraudulent immigration schemes.”
The investigation was conducted by the US Citizenship and Immigration Service and the U.S. Immigration and Custom Enforcement’s Homeland Security Investigations.
Cooperation Channels
This is not the first strike against immigration fraud under the CAA dealt by the District Attorney’s Office in Miami.
In April of 2013, 20 people were accused of falsifying and selling Cuban birth certificates to hundreds of illegal aliens to fraudulently secure permanent residency in the United States for them. Operation Havana Gateway was the largest action against fraud using Cuban documents of the last decade.
Several years ago, the United States and Cuba established a channel of cooperation to unmask immigration fraud by Latin American citizens pretending to be Cubans in order to obtain permanent residency and US citizenship. These collaborative efforts aim at verifying the authenticity of the documents, especially birth certificates, submitted by those who apply for permanent residency under the CAA.
The battle against immigration fraud is one of the issues tackled by migratory talks of recent years and today constitutes one of the matters to be addressed by the special commission that will resume negotiations in September, following the re-establishment of diplomatic relations between Cuba and the United States.

Hey there Moses, I can say quite a lot in “Classical Yoruba” and some in Bantú as they are my liturgical languages, part of my African Heritage which was officially recognized, accepted and studied only after the triumph of the Revolution. Can you speak, understand or have any notion of the ancestral languages and/or Culture on the African side of your ancestry? Do you even you have the slightest notion of that beyond watching “Roots”?

The issue of “Marriages of Convenience” is not peculiar to Cuban immigrants to the US. In fact, because of the CAA, Cuban citizens do not need to form fraudulent marriages to stay in the country. Immigrants from other countries engage in this form of immigration fraud far more often than do Cubans.
I would not be surprised to discover the Cuban government is involved in furnishing the false documents used by these criminals to sell to non-Cubans. Such a scheme would serve the Castro regime in two ways: firstly, it brings in cash, and secondly it undermines the CAA. There is evidence the Cuban government is involved in the medicare scams among recent Cuban immigrants in Florida, for the same motives: cash and as a means to undermine the USA. This was the same motivation behind the Cuban government involvement in the drug trade in the 1980’s. By allowing Cuban airspace & waters to be used as a trans-shipment zone for Colombian drug cartels smuggling drugs to the US, Castro brought in millions for the Revolution, while undermining US society.

It is correct that Canada’s laws are based on English law. (Scots law is different).
It is mythical to suggest that Canada is a different country under the current Government of Mr. Harper. There have been some policy changes, for example monthly payments to parents for every child under school age – previously there was no program supporting child care and the end of military action in Afghanistan which commenced under Jean Chretian. Nidal, Canada was heavily involved in both World Wars and is a member of NATO. Yes, the Blue Beret of the UN was a concept of a Canadian Prime Minister, Lester B. Pearson (the fellow that Toronto’s international airport is named after). But although not participating in George W. Bush’s invasion of Iraq, Canada was involved in Afghanistan, is involved in Syria against IS and it was a Canadian General who was in charge of the NATO attacks on Libya. In the case of Iraq, it could be said that the then Liberal Government took the right decision for the wrong reasons, because it did avoid Canada being party to the nonsense about “weapons of mass destruction” promulgated by Bush and which did so much to tarnish the reputation of General Colin Powell, Canada also fought in Korea – which you may recall was a UN action. Currently Canada has military advisors in Ukraine in opposition to the Russian motivated and controlled invasion of that country and has participated in naval operations in the Baltic. I wondered a little about your statement of having 18 grandfathers, so I hope it is helpful to explain that in western culture the only people so described are the fathers of ones mother and father (ie: 2) but should emphasize that I am not questioning whether you know of 18 relatives not being permitted to return to Israel, although 18% of the people of Israel are Arab and being a democratic country have the vote and can elect members of any party they chose unlike the people of Cuba.

Every aspect of America’s Cuban policy since the 1950s has undermined democracy and made the U. S. resemble a Banana Republic in the eyes of the rest of the world. It is all a direct consequence of the U. S. teaming with the Mafia in 1952 to support the Batista dictatorship in Cuba so rich U. S. businessmen could join the Batistianos and the Mafiosi to partake in the rape and robbery of a helpless smaller country. At least it was believed to be helpless till the Cuban Revolution shocked the world in January of 1959 by booting the thieves off the island, mostly to Miami. Then the second most shocking thing occurred: The U. S. government permitted the Batista/Mafia dictatorship to immediately and, it seems, permanently reconstitute itself on U. S. soil, mostly in Miami but also in Union City and subsequently in Washington. The Cuban Adjustment Act, Wet Foot/Dry Foot, and other laws easily rammed through an intimidated or bought-and-paid-for Congress have been solely designed to benefit Cubans at the expense of everyone else. What is surprising about this article is that even the federal government, after all these decades, is trying to rein in at least one aspect of that broad affront to democracy. Who knows? The U. S. government might yet decide that blowing up Cuban civilian airplanes, hotels, etc., is also wrong. But, as indicated in this article, the cottage industry that arises from pro-Cuban/anti-EVERYONE ELSE laws is something that is anticipated. For example, anti-Cuban zealots have dictated that draining Cuba of baseball stars, ballet performers, doctors, etc., harms Cuba…so such practices are rampant and spawn armies of unsavory recruiters, agents, etc. The thousands of Cuban doctors that serve in the poorest areas of poor countries are being severely targeted with lush rewards to defect, not to help the U. S. but to hurt Cuba. The Cuban Adjustment Act dates back to 1966 but, both before and after that date, Cuban laws designed to enrich or empower Cubans, or to sate their revenge against Castro, shame the U. S. democracy. If that is not so, perhaps some Cuban-American in Miami will explain to us in this forum why that is not so.
There are many countries that do not allow convicted felons to immigrate. The US is far from being an exception. Why should any country welcome felons or immigrants who having accepted refuge abuse the privilege and commit crimes?
Unfortunately for Dr. Ernesto Guevera’s record, he was responsible for the execution of over 350 Cubans at El Morro following the revolution in Cuba. That is fact. He went to Africa with the declared purpose of creating revolution in other peoples countries – you may respond that the purpose of the US embargo was to create another revolution in Cuba – if the US was wrong in its purpose, so was Che Guevera. He incidentally recorded in his diary that his actions in Africa were a: “history of failure”.
He next with financial support by the Castro family regime, turned his attentions to Bolivia in trying to create another revolution, but again failed and was executed by Bolivians.
Yes, it is correct that the Castro family regime through the Propaganda Department of the Communist Party of Cuba has turned the image of Che Guevera into the Cuban equivalent of Robin Hood and although dead for almost fifty years, his image is plastered over the classrooms of every school in Cuba.
To his credit, Che Guevera was a true revolutionary concerned following his motor-cycle trip around South America and seeing the abject poverty to try in his revolutionary way to create different living conditions. He never endeavored to enrich himself. As a devoted Marxist Che swallowed the idea of Stalin in trying to pursue the concept of: “the New Man”. Like Stalin he failed. I think that had Che lived and ever returned to Cuba, he would have been disgusted with the Castro family regime, its policies and avaricious motivations. As a revolutionary, Che would have deplored the cost of that ridiculous memorial and mausoleum in Santa Clara. believing that such expenditure should benefit the people. It is just a part of the Castro promotion and pursuit of the cult of the personality.
Your endeavors to blame the US for all the problems around the world are really quite foolish.
